I just received an application pack for some healthcare assistant bank shifts. This application pack still contains a thorough health questionnaire covering all sorts of questions, ranging from diabetes to mental health. Is it still legal for companies to ask this, considering the new legislation (Equality Act 2010, Section 60)? Should I just fill it in anyway, should I ignore it or should I call the company and ask for further advice? Thanks for all your answers. I generally have got no problem completing such a questionnaire. Hi from what i have been told yes you will have to answer it. Although you do not have to give any health/medical conditions at an interview, if you are offered the job they can then ask you for medical history.Well this is what i have been told by the DHSS or whatever they call themselves now.So if they have not already offered you the job then you do not have to give details.
You have to declare any medical problems you have but they cannot discriminate against you for it. If you are a diabetic/epileptic on medication and your health is managed, that is ok but it just lets the employer know that you may have to take prescribed meds for your condition. These questionnaires safeguard you as an employee and the employer should your health be a 'risk' but again, you cannot be discriminated against for it. If you have concerns, I would do as you suggest and call them - they will admire your honesty and will give you further advice. Any health condition has to remain confidential between employer and employee. This all boils down to the fear of being part of a lawsuit - if an employee i.e. has a mental health problem and 'snaps' with a colleague or patient whilst working, the employer can be sued for employing that person.

You need to prove you are fit to do the job which is why they are allowed to ask. If you don't fill it out then you won't be allowed to commence employment. The company I work for sends out this type of form not as a way to discriminate against potential employees but to assess if they are fit enough for the job & to offer assistance if there are any issues. For instance, I have had depression in the past so when I filled out my form I had to have an interview with the Occupational Health Dept. The doctor just wanted to check that I was well & make me aware of the free counselling my company offers, should I ever need it. I also have a latex allergy so I was given information about this. If you have any issues & don't declare them then it could bite you in the a*s at a later date.
Yes, they can ask it, as they are legally required to make sure you are fit enough to do the job, not a risk to patients or the patients aren't a risk to you. In the case of the NHS and other large organisations, the questionnaire is only seen by Occupational Health care professionals. They do not disclose your personal information to HR or prospective managers. They will inform them whether you are able to perform the role you have applied for, nothing more. They are legally allowed to request this information after a job is offered anyway.
